If you run an agency, a consultancy, a marketing firm, or any business that produces client-facing work, you should care about this even if you do not work in legal. The mechanism is the same. AI fabricates a fact, the human does not catch it, the work goes out, and the cost shows up later as a refund, a lost contract, a public correction, or a lawsuit.

A client's product feature that does not exist. A company's funding round in a year they did not raise. A historical event described in confident detail that did not happen that way. These are the hardest to catch because the AI is "mostly right" about the surrounding context.
What to Put in Place
You do not need a 40-page AI policy. You need three habits.
Habit 1: Source-or-Strike
For any AI-drafted external work product, every claim that includes a number, a citation, or a specific fact about a third party gets either a verified source link or gets struck before the work ships.
This sounds obvious. Most teams do not do it. The reason is that it adds 15 minutes to every draft, and AI was supposed to save you 15 minutes. The teams that get this right understand that the 15 minutes spent verifying is the price you pay for the four hours you saved drafting. The math still works in AI's favor. But it requires accepting that the time savings are not as large as they look.
Habit 2: Fact-Quarantine
When AI produces a draft that contains a factual claim you cannot verify on the spot, the claim goes into a "needs verification" list at the bottom of the doc. The work product does not ship until the list is empty.
This is a discipline more than a tool. The reason it works: it prevents the most common failure mode, which is "we will check it later" turning into "we shipped it and forgot."
Habit 3: Documented AI Use
For client-facing work, document somewhere (an internal log, a contract clause, a project file) that AI was used in the production. This sounds defensive. It is. The first wave of AI-related professional disputes in 2025 and 2026 has had a common pattern: the client argued they did not realize AI was involved. The agency or consultant argued they had assumed it was understood.
This argument is settled by paperwork, or by lack of paperwork. The teams with documentation win.
What This Means for Pricing
There is a quiet pricing implication here. The teams running AI-augmented workflows are more productive and taking on more risk. Most of them have not adjusted their pricing to reflect either.
You should be billing more per hour because each hour of your time is more valuable. You should also be either pricing in the verification overhead or, more sustainably, building it into your standard process so it does not feel like a tax. The teams that ignore both ends of this end up squeezed: doing more work for the same money, with more risk to boot.
The 2026 hallucination tax is not going away. It is becoming a category of business risk that needs the same kind of operational attention you give to legal liability, insurance, and contract review.
The studios that handle it well will treat it as a cost of doing business with AI. The studios that do not will keep being surprised by the bills.
